Contest is offered only in the United States (excluding California, Michigan, Pennsylvania, Tennessee and Puerto Rico) and is open only to legal residents of the United States (excluding California, Michigan or Pennsylvania residents) who are 21 years old or over as of date of entry. Contest begins November 17, 2006 at 12:00:01 p.m. Eastern Time (“ET”) and ends December 8, 2006 at 11:59:59 a.m. ET (“Contest Period”). The Contest Period has two sub-periods within it: 1) The Entry Period which begins November 17, 2006 at 12:00:01 p.m. and ends December 1 at 11:59:59 a.m. and 2) The Voting Period which begins on December 1 at 12:00:01 p.m. and ends December 8 at 11:59:59 a.m.
Employees, officers, directors and agents of W.J. Deutsch And Sons, Ltd. (“Sponsor”), Talbert Communications, Ltd., their respective parents, subsidiaries, affiliates, web masters and web suppliers, and manufacturers/importers/wholesalers/distributors/retailers of alcohol beverages [and their immediate families (parents, children, siblings, spouse) regardless of where they live or those living in the same household as such employees/officers/directors/agents (whether related or not)] are ineligible.
1. ENTRY.
Submit a photograph of yourself holding a glass (with our without wine) and/or
a bottle of Beaujolais Nouveau along with a caption of 10 words or less explaining
your pose. You are NOT required to feature actual bottle(s) of Georges Duboeuf
Beaujolais Nouveau wine in the photograph. But, if bottle(s) of Georges Duboeuf
Beaujolais Nouveau wine is not featured in the photograph, the photograph
must then contain a facsimile/reproduction of a Georges Duboeuf Beaujolais
Nouveau wine bottle.
During the Entry Period of the Contest, navigate on the Internet to the Beaujolais Nouveau web site at www.winewithoutrules.com. Click on the “Beaujolais Nouveau Strike A Pose Contest” button, which will take you directly to the online official entry form. Complete the online official entry form, typing your caption in the text box portion of the online official entry form. Attach a JPG or JPEG file with the photograph. Then, click on the “Submit” button to transmit your entry. All online entries must be received by December 1, 2006 at 11:59:59 a.m. ET.
Limit one entry (entry form; caption; photograph) per person. All elements of entry must be submitted online. Be sure to make a copy of all elements of entry prior to submission. Sponsor will not return or acknowledge receipt of entries.
Photograph and caption must be completely the original work of entrant. Entrant is solely responsible for obtaining consent from any person(s) or the owner(s) of any property appearing in his/her photograph or referenced in his/her caption; caption/photograph must not violate the trademark, copyright or other rights of person(s) or owner(s) of property included therein. Neither photograph nor caption may have been submitted to any other contest or competition. For submission, (a) caption must fit entirely within text box portion of the online official entry form and the use of any other online means of submitting the caption (including but not limited to e-mail messages or file attachments) is prohibited and (b) (digital) photograph must be attached as a file in .jpg or .jpeg format. Entries will be disqualified if photograph or caption features any content determined by Sponsor (in the sole discretion of said party) as indecent, inappropriate, morally objectionable or otherwise unfit for publication. Entries not satisfying the official rules in any respect (as determined by Sponsor, in the sole discretion of said party) will be disqualified.
No responsibility is assumed by Sponsor or its agencies for lost, late, incomplete, misdirected or illegible entries; or for any computer, telephone, cable, satellite, network, electronic or Internet hardware or software malfunctions, failures, connections, availability or garbled or jumbled transmissions, service provider/Internet/web site/use net accessibility or availability, traffic congestion or unauthorized human intervention.
Georges Duboeuf Beaujolais Nouveau T-Shirts (value, $15.00) will be given away to the first 100 eligible entries received during the Entry Period of the Contest.
2. VOTING.
All eligible entries will be posted for view on the www.winewithoutrules.com
website. Visitors to the website will be able to look through all eligible
entries for the entire duration of the Contest. Beginning December 1 at 12:00:00
p.m. all visitors to the www.winewithoutrules.com website can look through
all eligible entries and vote for their favorite photograph with caption.
The entry that receives the most votes during the Voting Period by 11:59:59
a.m. ET on December 8, 2006 will be declared the Grand Prize Winner. Winner
will be notified by certified postal mail on or about January 15, 2007.
3. WINNER.
GRAND PRIZE – The Grand Prize Winner of the Georges Duboeuf “Strike
A Pose” Contest will receive a new Panasonic Lumix DMC-FX9K 6-Megapixel
Digital Camera (value, $400.00).
To accept Grand Prize, winner must respond to the prize notification and then
show valid proof of age. If after 3 notifications by certified postal mail
the Sponsor is not able to get a hold of the winner, the Grand Prize will be
forfeited to an alternate eligible entrant. The Sponsor will declare the eligible
entrant with the second highest number of votes the Grand Prize Winner.
4. CONDITIONS OF PARTICIPATION.
Prizes are not transferable. No prize substitution except at sole discretion
of Sponsor, for a prize of equal value, due to unavailability of prize for
any reason. Winner is solely responsible for taxes on prize.
By participating, entrant (a) agrees to these Official Rules and the decisions of the Sponsor, which are final and binding in all respects; (b) releases and agrees to hold harmless W.J. Deutsch And Sons, Ltd., Talbert Communications, Ltd., their respective parents, affiliates, subsidiaries, agencies and the officers, directors, shareholders, representatives and employees of any of the above entities from any and all liability whatsoever arising from his/her participation in the Contest or acceptance, receipt, possession or use/misuse of prize. Where legal, by accepting prize, winner agrees to the Sponsor’s use of his/her name, photograph or likeness for advertising or publicity purposes, and any and all rights to said use, without notice or further compensation.
Grand Prize winner will be required to sign an Affidavit of Eligibility, Liability
Release, a Publicity Release (where legal) and other documents that Sponsor
may require, to be returned within 14 days of prize notification or prize
will be forfeited and an alternate winner selected.
Sponsor reserves the right, at its sole discretion, to disqualify any individual it finds, in its sole discretion, to be tampering with the entry process or the operation of the Contest or web site; or to be acting in violation of these official rules. Any attempt to defraud Sponsor (as determined by Sponsor or Sponsor’s agency, in the sole discretion of any party) will result in disqualification. Any attempted form of entry other than as set forth in these Official Rules is void. Any person who attempts to participate with multiple e-mail and/or street addresses, under multiple identities or uses any device or artifice to enter multiple times will be disqualified. Use of robotic, automatic, macro, programmed or like online entry methods is prohibited. In the event of a dispute as to online entries submitted by multiple users having the same email account, the authorized subscriber of the email account used to enter the Contest at the actual time of entry will be deemed to be the entrant and must comply with these official rules.
The authorized account subscriber is deemed to be the natural person who is assigned an email address by an Internet access provider, online service provider or other organization which is responsible for assigning email addresses for the domain associated with the submitted email address.
5. LIMITATIONS OF LIABILITY.
Sponsor and its agencies are not responsible for any incorrect or inaccurate
information, whether caused by web site users or by any of the equipment
or programming associated with or utilized in the Contest and assume no responsibility
for any error, omission, interruption, deletion, defect, delay in operation
or transmission, communications line failure, theft or destruction or unauthorized
access to the web site. Sponsor and its agencies are not responsible for
injury or damage to entrants' or to any other person's computer related to
or resulting from participating in this Contest or downloading materials
from or use of the web site.
If, for any reason, the online component of the Contest is not capable of running as originally planned by reason of infection by computer virus, worms, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsor which, in the sole opinion of Sponsor, corrupt or affect the administration, security, fairness, integrity or proper conduct of the online component of this Contest, Sponsor reserves the right at its sole discretion to cancel, modify or suspend the online component of the Contest. In such event, the judging of entries will consist of all eligible online entries received prior to and/or after (if appropriate) the action taken by Sponsor. Notice of such cancellation/modification/suspension will be posted on the web site.
